REGULAR COUNCIL MEETING
October 1, 2007
The Town Council met in regular session on Monday, October 1, 2007, in the Council Room of the Town Hall, 127 Center Street, South. Mayor M. Jane Seeman, called the meeting to order with the following members of Council present: Laurie G. Cole, Daniel M. Dellinger, Edythe F. Kelleher, George E. Lovelace, Michael J. Polychrones, and Maud F. Robinson. Also present were John H. Schoeberlein, Town Manager; Steven D. Briglia, Town Attorney; and Carol A. Orndorff, Town Clerk.
No invocation was offered at this meeting; the Pledge of Allegiance to the Flag of the United States of America was given.
APPROVAL OF THE MINUTES OF THE REGULAR COUNCIL MEETING OF SEPTEMBER 24, 2007.
It was moved that the Minutes of the Regular Council Meeting of September 24, 2007 be deferred to the next Regular Council Meeting.

RECEIPT OF PETITIONS AND COMMUNICATIONS FROM THE PUBLIC
Mrs. Lynn Sanderson 301 George Street, S.W., addressed Council and expressed appreciation to Chief of Police Carlisle for returning her call and discussing reciprocity procedures between the Town and Fairfax County. She then discussed with the Mayor and the Town Manager the inspections conducted on fire hydrants within the Town, required water flow. Mr. Schoeberlein assured Mrs. Sanderson that our Department of Public Works conducts periodic checks on both the hydrants and water flow calculations and further assured her that the Town met all Health Department criteria. Mrs. Sanderson requested that a Town Committee be formed, with Councilman Lovelace as Chairman, also comprised of several other Council Members, along with herself, to meet with the County for the purpose of inspecting the water and sewer lines; and also requested the Mayor to write the City of Falls Church regarding the current water charges. Mrs. Sanderson also spoke on the rates being charged the Town for water and sewer, to which the Mayor indicated the Town had met with the Fairfax County Water Authority and was currently waiting for a response as to potential costs and rates.
Councilman Dellinger also commented that the Water Authority was also conducting an inspection of the Town’s lines and developing a plan for potential inclusion within their system, along with estimated costs.
Matthew DiFiore, 207 Owaissa Court, S.E., addressed Council and spoke on the posting of the Town Council Agenda on line and the fact the background material of the items is not posted. That in order to view the background material he had to go to the library and to Town Hall to acquire this information. Mr. DiFiore stated the Town should have this material available on line; that the Town needs a policy on this matter. Mr. DiFiore also addressed the signing of Minutes by the Chairmen of the various Boards and Commissions and questioned how one would know the validity of the signatures. He also requested that the Minutes and Agenda of all the Boards and Commissions be posted on the Town’s web-site.
REPORT AND INQUIRIES OF COUNCIL MEMBERS
Councilman Polychrones spoke on the Governor’s proposed State Budget shortfall, and the fact that HB #599 funds which each locality having a Police force receives a percentage, would be reduced by 5%. In addition, funding for libraries, elections, etc., would also be reduced however, transportation and road maintenance funding to localities have not been cut to date.
Mr. Schoeberlein indicated the #599 funding reduction would equal $23,000.00 for the Town.
Councilwoman Kelleher spoke of the recent incident which occurred at Westbriar Elementary School, and the continuous vehicular dangers which occur and requested the Town Manager to request that a Police Officer be assigned to this site during the morning and afternoon hours. Mr. Schoeberlein stated the area was outside of the Town’s jurisdiction however, he would have Chief Carlisle speak to the proper people in the County requesting additional coverage.

PROPOSALS FOR ADDITIONAL ITEMS TO THE AGENDA
It was moved that the Regular Meeting of the Town Council be recessed for the purpose of meeting in Closed Session regarding matters of potential litigation, pursuant to Section 2.1-344.A(7) of the Virginia State Code.

At this time 8:26 P.M. the Regular Meeting of the Town Council recessed.
The Regular Meeting of the Council was reconvened at 8:45 P.M. Noted for the record that all Members of Council as previously recorded, were again present.
Mayor Seeman reported on the Closed Session convened at 8:45 P.M., stated the Members of Council had discussed with the Town Attorney matters of potential litigation; that no other business had been conducted.
It was moved that the Members of the Vienna Town Council be polled to affirm that during the Closed Session convened this date, October 1, 2007, the Town Council discussed matters of potential litigation with the Town Attorney. It was further moved that the Certification Resolution be adopted in accordance with State Statutes and the Town Clerk is authorized to execute the Certification Resolution. It was further moved that the Closed Session be continued to October 22, 2007 at 7:15 P.M. in accordance with Virginia Code Section 2.2-3711.A(1) for the purpose of discussing matters of personnel, specifically the conducting of interviews with individuals interested in appointment and/or reappointment to Town Boards and Commissions.
