REGULAR COUNCIL MEETING
OCTOBER 2, 2006


The Town Council met in regular session on Monday, October 2, 2006, in the Council Room of the Town Hall, 127 Center Street, South. Mayor M. Jane Seeman, called the meeting to order with the following members of Council present: Laurie G. Cole, Edythe F. Kelleher, Michael J. Polychrones, Maud F. Robinson, and Sydney H. Verinder. Councilman George E. Lovelace was absent. Also present were John H. Schoeberlein, Town Manager; Steven D. Briglia, Town Attorney; and Carol A. Orndorff, Town Clerk.

The invocation was offered by Councilman Michael J. Polychrones; followed by the Pledge of Allegiance to the Flag of the United States of America.



APPROVAL OF THE MINUTES OF THE REGULAR COUNCIL MEETING OF SEPTEMBER 25, 2006.

It was moved that approval of the Minutes of the Regular Council Meeting of September 25, 2006 be deferred to the next Regular Council Meeting of October 23, 2006.

RECEIPT OF PETITIONS AND COMMUNICATIONS FROM THE PUBLIC

Mrs. Lynn Sanderson, George Street, S.W., addressed Council and requested that a status report be provided her on the items of concern as previously requested during the summer. She also spoke on various vines and plants which are growing on the trees in the parks which she would like to see removed. Mrs. Sanderson also spoke on the leaf collection process and timing and the number of vehicles involved. She also reiterated that she is still willing to serve on the two committees, trash pickup and street lighting, which she had previously suggested.

Dr. Kim Danoff, Veterinarian, addressed Council and indicated that she would request that the Town Code be amended to allow for the boarding of exotic animals. She stated this is one of her primary interests and there is no other facility in the Northern Virginia area for this purpose. Dr. Danoff then provided a brochure which displayed the type of cages which would house the animals for benefit of Council. Upon discussion, Mayor Seeman indicated that she would request the Town Attorney and Director of Planning & Zoning to review the request and provide a report to the Town Council for consideration.

Ms. Laine Hyde, President, Historic Vienna, Inc., addressed Council and announced that their membership meeting would be held on Tuesday, October 10, 2006 at 7:30 P.M., at Town Hall. She indicated the speaker would be Mr. Philip Bigler, who was a Government and History teacher in Fairfax County for many years. Ms. Hyde stated Mr. Bigler’s topic for the evening is based on his work at Arlington National Cemetery and Capt. James Smith’s travels up the Chesapeake Bay.

Ms. Hyde handed out the first completed list of Historic Sites in the Town of Vienna Brochure, which are currently on the Historic Register with the Town. (Copy included in Official File of the Historic Register.) Ms. Hyde indicated that the Brochure is one of the legacy projects suggested by the Jamestown 2007 Committee.

Mr. Ed Turkely, 420 Yeonas Drive, S.W., addressed Council and spoke of motorists driving while utilizing cell phones along with blocking of intersections; and requested the Town Council to have the Police monitor more closely these types of offenses. Mayor Seeman indicated that in order to ticket a motorist in this regard, the State Legislature must enact appropriate legislation however, the Chief was present in the audience and would make note of Mr. Turkely’s request.


REPORT AND INQUIRIES OF COUNCIL MEMBERS

Councilwoman Robinson spoke on several issues relative to the Post Office. One, the elimination of the children’s art display and the fact the Post Office was being was no longer maintaining the planting/flower bed; and in addition, the Vienna Post Office was being renamed. She stated the House of Representatives has already approved the renaming in honor of two young men who lost their lives in Iraq; Christopher Perry and William Hecker, III. Councilwoman Robinson felt the Town should have been apprised of this Resolution and that the renaming represented another diminishing of the Town’s name. She further stated her comments were not meant to take anything away from honoring of the two young military men, as we all grieve for them and their families.

Councilwoman Cole reminded all present of the citizens meeting on Tuesday evening at Oakton High School regarding growth and development in Fairfax County. She also reminded everyone of the Optimist Walk on Saturday, “Growing Hope”, which will begin at the Community Center at 8:30 A.M.

Councilwoman Cole spoke on the recycling of newspapers and the Town’s previous consideration of this matter and the decision to utilize bags in lieu of bags. She stated that currently the Grocery Store bags are not of the same quality and various citizens have spoken of the difficulty in recycling the newspapers in the bags. She requested that this item be placed on a future Work Session for discussion and consideration.

Councilman Polychrones suggested that the matter be discussed in January at the mid-year Budget Review as it may involve financing to purchase the bins either this fiscal year or the next budget year.

Councilwoman Cole spoke on reading an article regarding invasive plants in the various County Parks and what a difficult problem it was to eliminate these plants. She stated the County has indicated they have a task force that can only handle one project each year; and with the problem of using chemicals you need licensed personnel. The news article encouraged citizens to address the problem in their own yard however, it is a huge problem throughout all the parks.



REPORT OF THE TOWN MANAGER

Mr. Schoeberlein stated the Department of Public Works this morning installed the 4-Way Stop Signs at the Tapawingo and Park Street intersection; warning flags and cones have been put in place for the next thirty days to warn the motorists.

Mr. Schoeberlein further stated that beginning on Tuesday, milling will take place on Park Street from Moore Avenue to Maple Avenue, beginning at 9:00 A.M.; paving will take place during the evening hours beginning at 7:00 P.M. Upon discussion it was the consensus that notification to the citizens will take place by utilizing the reverse 911 system.

Ms. Marie Kisner, Public Information Officer indicated that notification of the milling and paving had been placed on the Town’s web site.



REPORT OF THE MAYOR

Mayor Seeman announced that the VML Legislative Day would be held in Richmond on February 1, 2007.

The Mayor also stated that Ethics Day at James Madison High School would be held on November 9, 2006; and that table leaders were needed.

APPOINTMENT TO THE TOWN COUNCIL TO FILL THE UNEXPIRED TERM OF MR. SYDNEY VERINDER.

It was moved for the appointment of Mr. Daniel Dellinger to the Town Council to fill the unexpired term of Sydney Verinder. It was further moved that said appointment is effective this date, October 2, 2006 and will expire June 30, 2007.

REFERRAL OF A PROPOSED ORDINANCE TO AMEND THE TOWN CODE, CHAPTER 18, ZONING, ARTICLE 11, C-1, LOCAL COMMERCIAL ZONE REGULATIONS, SECTION 18-73, SPECIAL CONDITIONAL LIMITATIONS, RELATED TO APARTMENTS LOCATED IN COMMERCIAL BUILDINGS.

It was moved that the Proposed Amendment to Section 18-73 of the Town Zoning Ordinance be referred to the Planning Commission for public hearing, review and recommendation.

The Town Clerk at this time administered the Oath of Office to Mr. Dellinger who thereafter, took his seat at the Council dais.

It was moved to convene into Closed Session in accordance with the Motion adopted on September 25, 2006.

The Town Council convened in Closed Session at 8:35 P.M.




Mayor Seeman reconvened the Regular Meeting of Council at 9:45 P.M. Noted for the record that the following Members of Council were present: Cole, Dellinger, Kelleher, Polychrones,
Robinson, Mayor Seeman.

The Mayor reported on the Closed Session by stating that members of Council had discussed with the Town Attorney matters of potential litigation; and in addition had discussed matters of personnel relating to vacancies on Town Boards and Commissions. Mayor Seeman stated that no other business had been discussed.

It was moved that the members of the Vienna Town Council be polled to affirm that during the Closed Session convened this date, October 2, 2006, discussion relative to matters of personnel and discussion with the Town Attorney relative to probable litigation took place. It was further moved that the Certification Resolution be adopted and executed in accordance with State Statutes and the Town Clerk is authorized to execute the Certification Resolution. It was further moved that the Closed Session be continued to October 23, 2006 at 7:15 P.M. in accordance with Virginia Code Section 2.2-3711.A(1) for the purpose of discussing matters of personnel, specifically the conducting of interviews with individuals interested in appointment and/or reappointment to Town Boards and Commissions; and in accordance with Section 2.2-3711.A(7) for purposes of discussion with the Town Attorney regarding matters of probable litigation.
