PUBLIC HEARING ON A PROPOSED ORDINANCE TO AMEND THE CODE OF THE TOWN OF VIENNA, CHAPTER 10, OFFENSES – MISCELLANEOUS, ARTICLE 3, OFFENSES AGAINST PROPERTY, SECTION 10-20.1 NUISANCES – NOISE, SECTION (C), SUBSECTION 3, EXPANDING THE PROHIBITION OF CERTAIN NOISE ON SUNDAYS AND FEDERAL HOLIDAYS.
(Council will conduct a Public Hearing to consider prohibiting excavation, repair, or other construction type noise before 9:00 a.m. instead of 7:00 a.m. on Sundays, and also adding Federal Holidays between 8:00 p.m. and 9:00 a.m.)
Public Hearing closed; item deferred for content consideration.

PUBLIC HEARING ON PROPOSED NEW RENTAL RATES FOR THE VIENNA COMMUNITY CENTER.
(Council will conduct a Public Hearing on the rates and procedures to rent the Vienna Community Center, which were last adjusted in 2003.)
Public Hearing closed; rates approved; to be placed on agenda of 4/7/08 for adoption.
7.
RECOMMENDATION TO AUTHORIZE EXECUTION OF A “MEMORANDUM OF UNDERSTANDING” BETWEEN THE TOWN OF VIENNA AND THE VIENNA-TYSONS REGIONAL CHAMBER OF COMMERCE, FOR AN OKTOBERFEST / TASTE OF THE TOWN EVENT THIS OCTOBER.
(Council consideration to sign an agreement to establish the framework for a partnership with the Chamber of Commerce in planning and providing food, drink, entertainment and children’s events for a one-day event on Church Street and the Town Green.)
Approved.
8.
REQUEST FOR RELEASE OF THE 10% MAINTENANCE BOND IN THE AMOUNT OF $2,372.80 FOR THE SEKAS HOMES, LTD. SUBDIVISION LOCATED AT 1003 COTTAGE STREET, 300 AND 302 KINGSLEY ROAD, S.W.
(Council consideration to refund the public improvement bond since the project has been completed, certificates of occupancy have been issued, and the two-year waiting period has passed.)

REQUEST AUTHORIZATION TO EXPEND CAPITAL IMPROVEMENT PROJECT FUNDS IN AN ESTIMATED AMOUNT OF $12,926.00 FOR A PROPOSAL TO ANALYZE THE CAPACITY OF THE CULVERT BENEATH NUTLEY STREET NEAR THE INTERSECTION OF MARSHALL ROAD TO CONVEY STORMWATER, BECAUSE OF A PROBLEM WITH FLOODING IN A RESIDENCE THERE.
(Council consideration to approve a proposal from Tri-Tek Engineering, 690 Center Street, Herndon, Virginia to evaluate part of the Town’s storm water facilities.)

10.
REQUEST AUTHORIZATION TO EXPEND CAPITAL IMPROVEMENT PROJECT FUNDS IN AN ESTIMATED AMOUNT OF $12,138.00 FOR A PROPOSAL FOR ANALYSIS OF THE HYDRAULIC CONDITIONS AFFECTING A STORM INLET ON MEADOW LANE, S.W.
(Council consideration to approve a proposal from Tri-Tek Engineering of Herndon, Virginia to do a drainage analysis at a problem area.)
Approved.
11.
REQUEST AUTHORIZATION TO CONTINUE RIDING THE WASHINGTON METROPOLITAN AREA TRANSIT AUTHORITY CONTRACT WITH MANSFIELD OIL COMPANY OF GAINSVILLE, GEORGIA, FOR THE PURCHASE OF DIESEL FUEL IN AN ESTIMATED AMOUNT OF $90,000.00.
(Council consideration to continue riding this contract for diesel fuel.)

12.
REQUEST APPROVAL TO CONTINUE RIDING THE MONTGOMERY COUNTY, MARYLAND GOVERNMENT CONTRACT WITH MANSFIELD OIL COMPANY OF GAINSVILLE, GEORGIA FOR THE PURCHASE OF UNLEADED GASOLINE, WITH FUNDING APPROVED ON JUNE 4, 2007.
(Council consideration to continue riding contract number 4507000129CC, which has been extended until February 28, 2009.)
Approved in an amount not to exceed $160,000 for entire fiscal year.
13.
REQUEST AUTHORIZATION FOR ADDITIONAL APPROVED FISCAL YEAR 2007-2008 BUDGETED FUNDS IN AN ESTIMATED AMOUNT OF $46,018.00 FOR ASPHALT REPAIR FROM MOUNT VERNON ASPHALT & PAVING, INC. OF WOODBRIDGE, VIRGINIA, UNDER CONTRACT IFB 08-01.
(Council consideration to spend approximately an additional $46,018.00 over the original contract price in order to repair streets damaged by water and sewer breaks over the winter.)

14.
REQUEST APPROVAL TO EXPEND $10,800.00, AS REQUESTED BY THE DRUG ENFORCEMENT ADMINISTRATION, FROM THE VIENNA POLICE DEPARTMENT FEDERAL ASSET FORFEITURE ACCOUNT TO CONTRIBUTE TO THE WASHINGTON METROPOLITAN AREA TASK FORCE (M.A.T.F.) TO PARTIALLY OFFSET A BUDGET SHORTFALL IN THE CURRENT FISCAL YEAR.
(Council consideration to comply with the request of the D.E.A., as the Vienna Police Department is a member of the M.A.T.F., which shares assets which are seized from drug dealers and forfeited through the judicial process.)

15.
REQUEST APPROVAL TO EXPEND CAPITAL IMPROVEMENT PROJECT CONTINGENCY FUNDS IN AN AMOUNT NOT TO EXCEED $12,000.00 UNDER RFP 07-04 TO TRI-TEK ENGINEERING, TO CONDUCT AN ENGINEERING NEEDS ASSESSMENT FOR A SUPPLEMENTAL HVAC SYSTEM IN THE POLICE HEADQUARTERS SERVER ROOM.
(Council consideration to approve Tri-Tek to conduct an engineering analysis of systems specifications as well as the uninterruptible power supply through the existing generator and all corresponding electrical panels and connections.)

REQUEST APPROVAL OF A PROPOSED ORDINANCE TO REPEAL ARTICLE 7 OF CHAPTER 9 OF THE CODE OF THE TOWN OF VIENNA, TOWN VEHICLE LICENSES, REPEALING SECTIONS 9-64 THROUGH 9-70.
(Council consideration to abolish the requirement for Town stickers on vehicles.)
Approved; to be placed on agenda of 4/7/08 for adoption.
17.
ADOPTION OF A PROPOSED ORDINANCE TO AMEND THE CODE OF THE TOWN OF VIENNA, CHAPTER 3, ANIMALS AND FOWL, ADDING ARTICLE 4 “KEEPING OF WILD, EXOTIC OR VICIOUS ANIMALS PROHIBITED” AND SECTIONS 3-24, 3-25, 3-26, 3-27, 3-28, 3-29, 3-30, 3-31.
(Council consideration to expand the Town’s regulations on pets, keeping our regulations consistent with those of Fairfax County.)
Adopted.
18.
REQUEST APPROVAL TO PURCHASE CLEAR, OVAL CAR WINDOW DECALS INDICATING “TOWN OF VIENNA VIRGINIA.”
(Council consideration to purchase Town of Vienna car window decals, since residents will no longer have Town stickers for their vehicles.)
Approved to purchase 15,000 2-color decals in the amount of $1,500.00.
19.
REQUEST APPROVAL OF A PROCLAMATION DESIGNATING MAY 11TH THROUGH MAY 17TH, 2008 AS BUSINESS APPRECIATION WEEK.
(Council consideration to approve a proclamation in response to Governor Kaine’s request that all citizens of the Commonwealth observe Business Appreciation Week.)
