5. REQUEST FOR APPROVAL OF A FINAL PLAT FOR CARTERS GLEN III, A RESUBDIVISION OF TAX MAP PARCEL 38-3 ((2)) 127 LOCATED AT 321 NUTLEY STREET, S.W. IN THE RS-16, SINGLE FAMILY DETACHED RESIDENTIAL ZONE.
This request was filed by John Marshall, Land Design Consultants, agent for the owners Al Kazemi and Thomas Nabi. The new addresses would be 319 and 323 Nutley Street, S.W.

6. RECOMMENDATION TO APPROVE ACCEPTANCE OF FAIRFAX COUNTY AFTER-SCHOOL GRANT IN THE AMOUNT OF $20,000.00 EACH FOR FY05 AND FY06, THE ESTABLISHMENT OF NEW BUDGET DIVISION IN ACCORDANCE WITH THE RECOMMENDATION OF THE TOWN’S AUDITORS, AND THE SUPPLEMENTAL BUDGET APPROPRIATION FOR FY04 IN THE AMOUNT OF $20,000.00.
In July 2004 Fairfax County awarded the Town a two-year grant of $20,000.00 per year to establish a Middle School After-School program to be held at Club Phoenix. This program will not create any additional expenses for the Town.

7. RECOMMENDATION TO RIDE A FAIRFAX COUNTY CONTRACT WITH AMERICAN TENNIS COURTS, INC. TO REFURBISH TWO TENNIS COURTS AND ONE BASKETBALL COURT AT GLYNDON PARK, AND ONE BASKETBALL COURT AT SOUTHSIDE PARK.
The Fiscal Year 2005 budget allocated funds to do this, and the Town can ride Fairfax County contract #BL01-399876-12A with American Tennis Courts, Inc., who could complete the work this fall.

8. RECEIPT OF REQUEST BY VERIZON TO INSTALL NEW TELECOMMUNICATION AND VIDEO SERVICE FACILITIES IN THE TOWN OF VIENNA.
Verizon wishes to install new facilities in the Town right-of-way, with new fiber-optic cables above ground, except where facilities already exist underground. Verizon does not currently have a cable or video franchise agreement with the Town.

9. CONSENT AGENDA FOR THE POLICE DEPARTMENT, COVERING VARIOUS ITEMS FOR WHICH THEY HAVE BEEN AWARDED GRANTS.
9-1. Bureau of Justice Assistance Bulletproof Vest Grant Program
9-2. Local Law Enforcement Grant through the Virginia Department of Criminal Justice Services, for the purchase of police equipment.
9-3. Federal Office of Juvenile Justice and Delinquency Prevention for Vienna Police Department Detective assigned to the Northern Virginia Regional Gang Task Force.
9-4. State Homeland Security Grant Part II (1) to be used toward the cost of purchasing personal protective equipment.
9-5. State Homeland Security Grant Part II (2) to be used toward the cost of purchasing an integrated police Computer Aided Dispatch/Record Management System (CAD/RMS).
9-6. Commonwealth of Virginia Department of Motor Vehicles Smooth Operator Grant, anticipated to be used principally to pay overtime salaries associated with traffic safety goals.

10. REQUEST TO PURCHASE ONE 2005 FORD EXPLORER UNDER COMMONWEALTH OF VIRGINIA CONTRACT #5050-40-AF-C FOR THE POLICE DEPARTMENT, AS CONTAINED IN THE VEHICLE REPLACEMENT PROGRAM FOR FISCAL YEAR ENDING 2005.
The Virginia State contract for small SUV, Ford Explorer model year 2005, has been competitively bid. The cost would be $23,922.00.

11. DISTRIBUTION OF THE 2004-2005 DINING AND LODGING GUIDE.
The updated Dining and Lodging Guide has arrived and is ready to be distributed. The estimated cost to have it inserted into the Town Newsletter is $725.00.

12. APPROVAL TO RIDE PRINCE WILLIAM COUNTY CONTRACT WITH SITE WORKS, INC. OF MANASSAS, VIRGINIA, FOR CONSTRUCTION SERVICES, TO PROVIDE DRAINAGE IMPROVEMENTS OFF OF BLAIR ROAD.
Funding is to come from Capital Improvements Project funds with an estimated cost of $27,000.00.

13. AUTHORIZATION TO EXTEND IFB 03-03, HVAC MAINTENANCE, TO THE PBM LIMBACH GROUP.
The Department of Public Works wishes to extend Heating, Ventilation and Air Conditioning Contract IFB 03-03 with PBM Limbach Group of Lanham, Maryland for the second of four possible one year extensions, with an estimated cost of $30,955.92.

14. REQUEST AUTHORIZATION TO EXPEND ADDITIONAL APPROVED FISCAL YEAR 2004-2005 BUDGETED FUNDS WITH AN ESTIMATED COST OF $20,100.00 TO SAFEWARE, INC. OF LANDOVER, MARYLAND, FOR THE PURCHASE OF CLOTHING, UNIFORMS, AND ACCESSORIES.
In June 2004, Council approved riding Commonwealth of Virginia contract #2000101-40 as the lead jurisdiction for the cooperative purchase of clothing, uniforms, and accessories. This request is for additional approved FY 04-05 funds to cover the purchase of uniforms, accessories, and OSHA required signs, for general operations and water and sewer divisions.

15. REQUEST FOR WAIVER OF PERMIT FEES AND OTHER FEES ASSOCIATED WITH THE SPRINKLER SYSTEM BEING INSTALLED AT VIENNA VOLUNTEER FIRE DEPARTMENT, STATION NO. 2.
The President of the Vienna Volunteer Fire Department has requested a waiver of the fees, which would cost the Town $5,875.00 in lost revenue.

16. SET DATE FOR PUBLIC HEARING ON A PROPOSED ORDINANCE TO AMEND CHAPTER 18, ZONING, ARTICLE 18, SUPPLEMENTAL REGULATIONS, BY ADDING A NEW SECTION 18-173.16, SECURITY FENCES, TO THE CODE OF THE TOWN OF VIENNA.
This addition to the Town Code regarding security fences will enable the Town to provide such measures when it is needed. The Public Hearing will be conducted in November.

17. PROPOSED ORDINANCE TO AMEND CHAPTER 18, ZONING, ARTICLE 2, DEFINITIONS, SECTION 18-4, DEFINITIONS, SPECIFICALLY THE TERM “SHOPPING CENTER.”
The Proposed Ordinance would amend the definition of the term “Shopping Center” to make it a group of four (instead of five) contiguous retail stores, or a building of contiguous retail stores having a total ground floor building area of not less than 10,000 square feet.
