5. PUBLIC HEARING ON A PROPOSED ORDINANCE TO AMEND CHAPTER 18, ZONING, ARTICLE 2, DEFINITIONS, OF THE CODE OF THE TOWN OF VIENNA.

[This is the Code change that adds “patios and decks” to the definition of the word “structure.” The Town Attorney has now also added the following sentence to the definition: “This definition shall not apply to the definition of residential structure as referenced in Chapter 6, Article 6 of the Code of the Town of Vienna.”]

Public Hearing closed; item deferred for further clarification.





6. DISCUSSION RE: HISTORIC DISTRICT DIRECTIONAL SIGNS.

[Residents of the Historic District would like to have a chance to air their concerns in an open, public forum.]

Deferred to September Work Session.







7. FIBER-OPTIC WIDE AREA NETWORK FUNDING AND RFP.

[This was deferred from the Council Meeting of May 24, 2004. The Town Council will consider using a pre-existing fiber-optic cable network to transmit voice, data, and video between Town buildings.]

Approved.






8. PHONE SYSTEM UPGRADES WITH FIBER-OPTIC NETWORK.

[This was deferred from the Council Meeting of May 24, 2004. If the Town Council decides to use the fiber-optic cable network (see item #7 above), then it will consider purchasing digital phones and preparing the fiber-optic network.]

Approved.





9. MAINTENANCE AGREEMENT FOR TELECOMMUNICATIONS SYSTEM.

[Requesting authorization to contract Siemens ICN for maintenance on the phone system which they designed, built, and installed, and which uses their hardware and software systems for operation, voicemail, and battery backup components.]

Approved.





10. ADOPTION OF THE REVISED SOLID WASTE MANAGEMENT PLAN.

[The Virginia Waste Management Board has required local and regional jurisdictions to submit a revised solid waste management plan to the Department of Environmental Quality by July 1, 2004.]

Adopted.





11. COUNCIL AUTHORIZATION TO ELIMINATE THE PICK-UP OF WHITE GOODS.

[The special pick-up program would no longer collect things such as refrigerators, stoves, dishwashers, air conditioners, furnaces, washers, dryers, etc., as of January 1, 2005.]

Approved.





12. ACCEPTANCE OF PUBLIC IMPROVEMENTS AT THE KADONOFF SUBDIVISION, 302 GLYNDON STREET AND 306 GLYNDON STREET S.E.

[Sekas Homes Ltd. requests the reduction of its public improvement bond, and acceptance of the public improvements into the Town’s system for maintenance.]

Approved.







13. CONSENT AGENDA – REQUESTING APPROVAL FOR CONTRACT EXTENSIONS, CONTINUED USE OF SOLE SOURCES, RIDING OTHER CONTRACTS, EXPENDING FUNDS ON CONTRACTS, ETC. FOR THE DEPARTMENT OF PUBLIC WORKS.

[Expenditure requests in this grouping of items include such ongoing routine things as concrete, gasoline, gravel, industrial supplies, clothing, traffic signal equipment, repair facilities, engineering services, utility mark-off services, and use of Lorton Landfill.]

Approved.






14. A PROPOSED ORDINANCE TO AMEND CHAPTER 20, REGULATING CONDUCT IN PUBLIC PARKS AND RECREATIONAL FACILITIES, ARTICLE 4, RECREATIONAL ACTIVITIES, SECTION 20-11, WEAPONS, OF THE CODE OF THE TOWN OF VIENNA.

[This Ordinance would change the wording in the section of the Town Code regulating conduct in public parks and recreational facilities to match the wording in the State Code.]

Approved; to be placed on Agenda of July 12, 2004 for adoption.








15. A PROPOSED ORDINANCE TO AMEND CHAPTER 18, ZONING, ARTICLE 18, SUPPLEMENTAL REGULATIONS, BY ADDING SECTION 18-173.16, SECURITY FENCES, TO THE CODE OF THE TOWN OF VIENNA.

[It is being suggested that this amendment be sent to a work session for further review.]

Deferred to Work Session of September 20, 2004.







16. APPOINTMENT OF MR. MELVIN MCCOY TO THE PLANNING COMMISSION; AND MS. ALICE PUTMAN TO THE TRANSPORTATION SAFETY COMMISSION.

Approved.







17. ACCEPTANCE OF LETTER OF RESIGNATION OF MR. ELMER CLEGG FROM THE TOWN/BUSINESS LIAISON COMMITTEE.

Accepted.








18. APPOINTMENT OF TOWN OFFICIALS.

[Reappointment of the Town Manager, the Town Attorney, the Town Treasurer, and the Town Clerk.]

Appointed.







19. ADOPTION OF PROPOSED ORDINANCE TO AMEND CHAPTER 3 OF THE CODE OF THE TOWN OF VIENNA, ANIMALS AND FOWL, ARTICLE 2, DOGS GENERALLY, SECTION 3-6, OWNER ALLOWING DOGS TO RUN PROHIBITED.

[The Public Hearing on this proposed Ordinance amendment was conducted June 7, 2004. The amendment provides that “any person violating this section shall be guilty of a Class 4 misdemeanor and punished by a fine not to exceed Two Hundred and Fifty Dollars.”]

Adopted.







20. ADOPTION OF A PROPOSED ORDINANCE TO AMEND CHAPTER 6, FINANCE AND TAXATION, ARTICLE 2, UTILITY TAXES, OF THE CODE OF THE TOWN OF VIENNA, ADDING A NEW LOCAL TELECOMMUNICATION TAX PROVISION.

[This Ordinance amendment will permit the Town of Vienna to collect this tax in lieu of being collected by Fairfax County.]

Adopted.







21. SET DATE FOR CLOSED SESSION FOR MATTERS OF PERSONNEL.

[The Town Council must conduct its organizational meeting for the Fiscal Year 2004-2005, and consider local committee appointments.]
